These Terms of Service (“Terms”) govern your access to and use of Loralume (the “Service”), operated by Loralume (“we”, “us”, or “our”). By creating an account or using the Service, you agree to be bound by these Terms.

1. Description of Service

Loralume is a personalized AI portrait service. Customers upload photographs of themselves, consenting family members, or their own pets. We use those photographs to train a personalized AI portrait model that recognizes the subject's likeness. We then generate portrait images across the styles you select and deliver those images (and, on some plans, the underlying trained AI portrait model file) for your personal use.

2. Eligibility

You must be at least 18 years old and legally competent to enter into a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

3. Account Registration

You will provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

4. Subject Consent & Age Verification

By uploading photographs, you represent and warrant that:

Every human subject depicted (a) is you, or (b) has given you clear, informed, revocable consent to have their likeness used to train an AI portrait model and generate derivative imagery;
No human subject depicted is under the age of 18, except in the case of your own minor child where you (i) are the child's parent or legal guardian, (ii) have completed the age-verification workflow, and (iii) have selected only family-safe theme packs;
You possess sufficient rights in the photographs (either as photographer, owner, or licensee) to authorize their processing;
The photographs do not depict any person who has withdrawn consent, is a public figure being impersonated, or is otherwise subject to any restriction on their likeness rights.

Verification. Where applicable, we require a face-scan verification of the subject (or reuse of the account holder's existing verification). We may reject or reverse any order where verification is not satisfied.

5. Prohibited Uses

You may not use the Service to:

Upload photographs of any person who has not given their explicit, informed consent, including public figures, celebrities, coworkers, ex-partners, or any other third party;
Train models on, or generate images of, sexually explicit content, nudity, or pornography, whether human or otherwise;
Produce, distribute, or store material that depicts a minor in a sexual, sexualized, or exploitative context (“CSAM”). This is an absolute prohibition. Uploads suspected of CSAM will be reported to the National Center for Missing & Exploited Children (NCMEC) as required by 18 U.S.C. § 2258A;
Generate imagery for the purpose of harassment, defamation, revenge porn, non-consensual intimate imagery, election interference, fraud, or impersonation;
Generate imagery of deceased individuals without appropriate consent from their estate or living family, where such consent is required by applicable law (“post-mortem publicity rights”);
Reverse-engineer, decompile, or attempt to extract the source code, model weights (other than a delivered AI portrait model file licensed to you), or training pipeline of the Service;
Use the Service in any manner that violates any applicable law, regulation, or third-party right.

6. Content Moderation

Every uploaded photograph is scanned by an automated content-moderation system before processing. The system may reject photos that appear to depict prohibited content, unverified minors, or violations of these Terms. Rejections are final and non-appealable except at our sole discretion.

We reserve the right to review, delete, or refuse to process any content at any time for any reason.

7. Your License to Deliverables

Subject to your compliance with these Terms and payment of applicable fees, we grant you a perpetual, non-exclusive, non-transferable license to the delivered images and (where applicable) the delivered trained AI portrait model file for personal, non-commercial use.

Commercial use. Commercial use of delivered images is permitted only where all human subjects depicted have given explicit written permission for that specific commercial purpose. Loralume makes no representation as to the fitness, non-infringement, or commercial viability of any generated image.

8. Our License to Uploaded Content

You retain ownership of all photographs you upload. You grant us a limited, non-exclusive license to use your uploaded photographs solely to (a) perform the Service (training and generation) for your account, (b) enforce these Terms and applicable law, and (c) improve safety systems in anonymized, aggregated form. We do not use your photographs to train models for any other user, sell them to third parties, or use them for marketing without your explicit opt-in consent.

9. Data Retention & Deletion

See our Privacy Policy for full detail. In summary: uploaded photographs are retained only as long as necessary to complete your order and honor refund/dispute periods, then deleted. Delivered trained AI portrait model files remain in your Library until you delete them or your account is closed. You may request full account deletion at any time by contacting privacy@loralume.com.

10. Fees, Payment & Refunds

Prices are displayed at time of order and charged in U.S. dollars via our payment processor. See our Refund Policy for the current refund terms. Chargebacks initiated without first contacting our support team may result in account termination.

11. Intellectual Property

The Service, including all software, model architectures, and content moderation systems, is our intellectual property or that of our licensors. Nothing in these Terms grants you any right in our intellectual property beyond the limited license expressly set forth above.

See our DMCA Policy. Repeat infringers will have their accounts terminated.

13. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. We do not warrant that (a) generated images will meet any particular quality standard or match any particular expectation, (b) the Service will be uninterrupted or error-free, or (c) any AI portrait model delivered will function identically across all downstream tools.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL LORALUME BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE. OUR AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE PRECEDING TWELVE (12) MONTHS.

15. Indemnification

You agree to indemnify and hold Loralume harmless from any claim, demand, or damages, including reasonable attorneys' fees, arising out of (a) your breach of these Terms, (b) any content you upload, or (c) your violation of any third party's rights, including publicity, privacy, or intellectual property rights.

16. Termination

We may suspend or terminate your account at any time for violation of these Terms, particularly around consent, minors, or prohibited content. Such terminations are non-refundable. You may terminate your account at any time by contacting support.

17. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws principles. Any dispute shall be resolved in the state or federal courts located in California.

18. Changes to These Terms

We may modify these Terms at any time. Material changes will be notified via email or in-app notice. Continued use after the effective date of any change constitutes acceptance.
